Terms of use

1. Acceptance of the terms

By accessing and using the Mistura Certa app ("App", "Service"), the user declares having read, understood and fully agreed to these Terms of Use.

If you do not agree with any provision, we recommend that you do not use the app.

2. Description of the service

Mistura Certa is a mobile app that lets users:

• Browse the recipes included in the app;
• Create and store their own recipes;
• Organize ingredients and nutrition calculations;
• Plan meals and build the shopping list;
• Track streak, achievements and coins;
• Back up their own data.

The app works without an account or sign-up, with data stored on the user’s device.

The app has a free version, with ads, and a paid version (Premium Plan).

3. Eligibility

To use the App, you must:

• Be at least 13 years old;
• Be able to enter into a legally binding contract, or have permission from your parents or guardians;
• Not be barred from using the service under applicable law.

4. User data on the device

4.1 Use without an account

The app requires no sign-up, login or password. All content you create is stored on the device.

4.2 Responsibility for data

• We have no copy of your data and cannot recover it;
• If you uninstall the app, switch devices or clear its data without a backup, the content is lost;
• Back up regularly;
• Cloud backup depends on the services and accounts you choose (Google Drive or Microsoft OneDrive);
• Device security is the user’s responsibility.

5. Subscriptions and payments

5.1 Premium plans

• Monthly Plan and Annual Plan;
• The price is the one shown by Google Play before you confirm the purchase;
• There may be a free trial. When it ends, billing starts automatically unless you cancel before then;
• The features included in Premium are those described in the app at the time of purchase.

5.2 Automatic renewal and cancellation

• Subscriptions renew automatically unless the user cancels;
• Charges are processed through the Google Play Store;
• Cancellation, billing and refunds follow the Google Play Store rules and applicable law, including the Brazilian Consumer Protection Code;
• Premium access is kept until the end of the paid period;
• If the subscription ends, the data stays on the device, but Premium features are no longer available.

5.3 Price changes

• Prices may change with 30 days’ prior notice;
• Current subscribers: the new price applies at the next renewal;
• Notice through Google Play and in the app.

6. Free plan and ads

• The free plan shows third-party ads served by Google AdMob;
• We do not control the content of ads or the products advertised, and we are not responsible for them;
• Some features may be unlocked for a limited time by watching an ad, at the user’s choice;
• The Premium subscription removes ads.

7. User content

7.1 Ownership

• You keep all rights to the recipes and content you create;
• This content stays on your device and is not published or shared by the app.

7.2 Responsibility for content

The user is solely responsible for:

• The content they add, including text, recipes and photos;
• Not infringing copyright;
• Having the right to use the images they add.

8. Intellectual property rights

8.1 Our property

All institutional content, brand, layout, features and recipes included in the app belong to Mistura Certa or its licensors and are protected by applicable law.

8.2 Permitted use

You may use the App for personal, non-commercial purposes, in accordance with these Terms.

8.3 Prohibited use

It is prohibited to:

• Copy, modify or distribute the App;
• Reverse engineer it;
• Remove proprietary notices;
• Use it for unauthorized commercial purposes.

9. User conduct

You agree NOT to:

• Break laws or regulations;
• Infringe the rights of third parties;
• Use the service for illegal purposes;
• Attempt to hack or compromise security;
• Circumvent ads, technical limits or the subscription;
• Tamper with coins, streak, achievements or items;
• Use bots, scripts or unauthorized automation;
• Sell, resell or commercially exploit the service.

10. Coins, achievements and items

• Coins, streak, achievements and in-app store items are entertainment features;
• They have no cash value and cannot be exchanged, sold or transferred;
• They are stored only on the device;
• The rules and values of these features may be adjusted in app updates.

12. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability;
• Fitness for a particular purpose;
• Non-infringement of third-party rights;
• Continuous or error-free availability.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

• Loss of data stored on the device;
• Failures of third-party services, including app stores, cloud services and ad networks;
• The accuracy or outcome of the recipes;
• Any damage arising from the use of the recipes, including food allergies or intolerances.

Liability is limited to the amount paid in the last 12 months. Nothing in these Terms limits rights the law grants to consumers.

14. Indemnification

You agree to indemnify, defend and hold Aura Cubic Digital harmless from:

• Breach of these Terms;
• Infringement of third-party rights;
• Misuse of the Service.

15. Nutrition information

15.1 Important notice

• Nutrition information is an estimate;
• Based on the Brazilian Food Composition Table (TACO);
• It does not replace advice from a nutritionist.

15.2 Responsibility

• You are responsible for checking the information;
• Consult a health professional for specific diets;
• We are not liable for adverse reactions.

16. Suspension and termination

16.1 By us

Mistura Certa, at the app developer’s discretion, may suspend or discontinue features, temporarily or permanently, especially in the following cases:

• Breach of these Terms of Use, the Privacy Policy or applicable law;
• Non-compliance with the Google Play Store guidelines;
• Improper, abusive or fraudulent use of the app;
• Practices that compromise the security, integrity or operation of the app;
• Technical, commercial, operational or strategic reasons.

16.2 By the user

The user may stop using the app at any time by deleting their data in Settings and uninstalling the app. The subscription must be cancelled on Google Play.

16.3 Effects of termination

• Loss of access to the service;
• Data stays on the device until the user deletes it;
• No refund for unused periods, unless required by law.

17. Changes

17.1 Changes to the terms

We may change these Terms at any time. Significant changes will be announced:

• 30 days before they take effect;
• Through a notice in the app;
• Continued use means acceptance of the new terms.

17.2 Changes to the service

We reserve the right to:

• Modify or discontinue features;
• Change functionality;
• Add or remove services.

18. General provisions

18.1 Governing law

These Terms are governed by the laws of Brazil, without regard to conflict of law provisions.

18.2 Jurisdiction

The courts of the user’s place of residence have jurisdiction, under the Brazilian Consumer Protection Code.

18.3 Severability

If any provision is held invalid, the remaining provisions stay in force.

18.4 Waiver

Failure to exercise a right does not constitute a waiver.

18.5 Entire agreement

These Terms are the entire agreement between you and Aura Cubic Digital.

18.6 Assignment

You may not assign these Terms. We may assign them at any time.

20. Dispute resolution

20.1 Informal negotiation

We will try to resolve disputes informally first.

20.2 Arbitration

Unresolved disputes may be submitted to arbitration under:

• The Brazilian Arbitration Law (Law 9,307/96);
• A Mediation and Arbitration Chamber.

20.3 Exceptions

Small claims may be brought before the small claims court.
